Fashion Private Limited (“Company”/ “We”/ “Us”/ “Our”) collects, stores, uses, and/or discloses information
or data shared by our users (“You”/“Your”/“Customer”) when You access Our Platform or use our Services or
interact with us through email, text and other modes of communication whether as a registered user or
otherwise.
We urge You to carefully read and understand the Privacy Policy. By accessing the Platform, You agree to and
give Your consent and acceptance to the terms and conditions mentioned herein, including the manner of
collection, storage and use of Your Personal Information. In case You disagree with the terms and conditions of

This Privacy Policy is an electronic record in the form of an electronic contract formed under the Information
Technology Act, 2000 and the rules made thereunder including any amendments thereto. This Privacy Policy
does not require any physical, electronic or digital signature. This Privacy Policy is published and shall be
construed in accordance with the provisions of the Information Technology (Reasonable Security Practices and
Procedures and Sensitive Personal Data of Information) Rules, 2011 under the Information Technology Act,
2000; which requires publishing of the privacy policy for the collection, use, storage and transfer of sensitive
personal data or information.
In this Privacy Policy, capitalised terms unless otherwise defined herein shall bear the same meanings as
ascribed to them under terminologies in the Terms of Use shall be applicable.
1. Revisions to Privacy Policy:
We reserve the right to update and revise this Privacy Policy at any time. You can determine if this Privacy
Policy has been revised since Your last visit by referring to the “Last Updated” date at the top of this page. You
should therefore periodically review this Privacy Policy to ensure that You are aware of its terms and
amendments. Your continued use of the Platform following the update to the Privacy Policy constitutes Your
acceptance of the terms of the Privacy Policy as amended or revised by Us.

This Privacy Policy covers Our treatment of Information that the Company collects and receives, including
Information related to Your past use of the Platform. Technology and security policies, rules and other

device (such as your PC, tablet, or another mobile device), Your use of our Platform (as well as certain
third-party websites with whom we have partnered), and/or Your personal preferences, interests, or
geographic location. Examples of these types of information include:
i. Geographic location, which automatically becomes accessible to Us by virtue of You accessing
the Platform on Your device
ii. Usage Data information such as the Internet Protocol address (IP address) of your device,
operating system, browser type, browser version.
iii. the pages of our Service that you visit, the time and date of your visit, the time spent on those

iv. unique device identifiers and other diagnostic data. This information may also include the URL
that you just came from (whether this URL is on the website or not, your computer browser
information, and other information associated with your interaction with the Service.

3.3. Stored Information: We store all data that is shared by You or by a third party on Your behalf such as
image files, documents etc. either at the time of accessing the Platform or on information provided by
You through social media platforms such as but not limited to WhatsApp and Instagram or at a later
stage.
Personal Information, Sensitive Financial Information, Automatic Information and Stored Information
shall individually be referred to as “Personal Information”, “Automatic Information”, “Stored
Information” and collectively as “Information”.
Information does not refer to any content that You may share with Us for the purposes of publishing on Our
Platform. Such content shall be governed by Our Terms of Use.

address information from Our carriers, which we use to correct Our records and deliver your
next purchase more easily. We will only retain Personal Information and such other Information
as long as necessary for the fulfillment of such purposes and to meet legal requirements and

Platform;

8. Data retention:
8.1. Unless a longer retention period is required or permitted by law, we will only hold Your Personal
Information on Our systems for the period necessary to fulfil the purposes outlined in this Privacy Policy.
8.2. Even if We delete Your Personal Information, it may persist on backup or archival media for legal, tax or
regulatory purposes.
8.3. We will also retain Automatic Information for internal analysis purposes. Automatic Information is
generally retained for a shorter period of time, except when this data is used to strengthen the security or
to improve the functionality of our Service, or we are legally obligated to retain this data for longer
periods.

The Platform takes Your security seriously and We take precautions to keep Your Information secure. We have
put in place appropriate physical, electronic and managerial procedures to safeguard the information that We
collect. However, due to the open communication nature of the internet, We cannot guarantee that
communications between You and the Company, or information stored on Our Platform, will be free from

We will not be liable to you for any issues arising in connection with their use of your information and we
encourage you to read the Privacy and Cookie Notices and Conditions of Use of any linked, referenced, or
interfacing websites and services you visit or use.
11. USER PROFILE ON THE WEBSITE
We will keep your Personal Information in our possession accurate, complete, current and relevant,
based on the most recent information made available to us. If you have provided any Personal
Information or Information about yourself, and would like to modify them, you may do so at any time
by signing in and changing your profile settings and information. You can also email to us at
privacy@theethnic.co. You agree that the Company will not be liable directly, indirectly, incidentally or
consequentially for any damages or liability as a result of disclosing Personal Information or other
Information through your account including your profile with any third party for the fulfilment of
services.

We post customer testimonials and reviews on our Website which may contain Personal Information.
We do obtain the customer's consent via email prior to posting the testimonial to post their name along
with their testimonial. If you would like to request to have your testimonial or review removed from our
Website you may email us at privacy@theethnic.co. We make efforts to keep such testimonials or
review or pictures secure, however we cannot guarantee cent percent security for such testimonial
reviews or picture and such testimonial can be misused by third parties. We use a third party email
provider to store emails you send us. You agree and confirm that such testimonials and review shall be
our property.
12. Service Providers:
We may employ or partner with third-party companies and individuals to facilitate our Service (“Service
Providers”), provide the Service on Our behalf, perform Service-related services or assist Us in analyzing
how Our Service is used. These third parties may have access to your Personal Information only to
perform the tasks on our behalf and are obligated not to disclose or use it for any other purpose. The third
parties with whom information may be shared includes but is not limited to:
i. We use a third party server to host our Website. Our Website server automatically logs the IP
address you use to access our Website as well as other information about your visit such as the
pages accessed, information requested, the date and time of the request, the source of Your
access to our Website (for instance the website or URL (link) which referred You to our
Website), and Your browser version and operating system). Our third party hosting service
provider stores server logs to ensure network and IT security so that the server and Website
remain uncompromised. This includes analyzing log files to help identify and prevent
unauthorized access to our network, the distribution of malicious code, denial of services attacks
and other cyberattacks, by detecting unusual or suspicious activity. Unless, We are investigating
suspicious or potential criminal activity, We do not make, nor do We allow our Website server
provider to make any attempt to identify You from the information collected via server logs.
ii. We collect measurements data which may be either body measurements, or garment
measurements, which we store on our servers for better user experience next time when the same
customer visits our Website. You agree and confirm that we can share your such measurements
with tailors / designers who may be our third-party service provider to customize your garments.
iii. We will also be sharing your Personal Information with our logistic partner for shipping the
product to You.
iv. We use other third party service providers such as short message service provider to deliver
messages such as OTP, transactional and promotional messages on our behalf.
v. Payments: We have engaged external service providers who provide payment gateways on our
Website. In order to process your payment, we use a number of third-party payment processors,
including but not limited to Cashfree, Razorpay, Mobikwik, PayTM, AmazonPay, Verifone, 2
Checkout, Paypal. Your payment will be processed by the payment provider You choose to
process Your payment via a payment gateway. The payment gateway has not necessarily been
screened or reviewed by Us and We are neither responsible for the privacy practices or the
contents of such payment gateway nor shall be held answerable for the inaccurate, or
inappropriate information which appears on such payment gateway. The said payment gateway
may contain cookies. While We use cookies in other parts of the Website, cookies received with
the payment gateway are / may be collected by such service provider and we do not have access
to that information.
It will be presumed that payment is made out of Your bank account / credit card / debit card
through payment gateway and not from third party account. Payment and other terms of the
payment gateway shall be read and understood by You, before commencing any transaction with
us. Please note the moment You opt for the payment gateway services You will be transferred to
the application / website of payment gateway service provider and We will not be liable for any
activities/ transactions entered between You and payment gateway service provider.

Our Privacy Policy does not address, and we are not responsible for the privacy, use, collection, storage or
transfer of information or other practices of any third party, including but not limited to payment gateways to
which the Website links. The inclusion of a link on the Website does not imply our endorsement of the linked
application or such services. Please note that We are not responsible for the collection, usage and disclosure
policies and practices (including data security practices) of any third party. We do not collect any financial
information, card number, cvv, etc. Such information are entirely handled by third party payment gateway
service providers.

13. Legal Disclaimer:
We reserve the right to disclose Your personally identifiable information as required by law and when we
believe that disclosure is necessary to protect Our rights and/or to comply with a judicial proceeding, court order
or legal process served on Our Platform. We may be required to share the aforesaid information with
government authorities and agencies for the purposes of verification of identity or for prevention, detection,
investigation including cyber incidents, prosecution and punishment of offences. You agree and consent for the
Company to disclose Your Information, if so required under the applicable law.
14. A Special Note about Children:
The Services under the Platform are not directed towards children under the age of 18 (eighteen). They are not
allowed to register with or use the service or provide personal data. If you are a parent or guardian and you are
aware that your Child has provided us with Personal Information, please contact us. If We discover that We have
collected personal information from a child under 18 without verification of parental consent, We will take steps
to remove that information.
15. Governing Law:
The laws of India shall govern this Privacy Policy, regardless of Your location. You hereby expressly consent to
exclusive jurisdiction and venue located in Bangalore, India, for all matters or disputes arising out of or relating
to the Terms of Use or Your access or use of the Platform and Services.
ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE TERMS OF USE OR YOUR USE
OF THE PLATFORM MUST BE BROUGHT BY YOU WITHIN ONE (1) MONTH OF THE DATE SUCH
CAUSE OF ACTION FIRST AROSE, OR SUCH CAUSE OF ACTION IS FOREVER WAIVED BY YOU.
EACH CAUSE OF ACTION SHALL BE ADJUDICATED INDIVIDUALLY, AND YOU AGREE NOT TO
COMBINE YOUR CLAIM WITH THE CLAIM OF ANY THIRD PARTY.
16. CLAUSES SPECIFIC TO USERS WHO ARE DOMICILED IN EUROPE
While we process your data, we strictly adhere to the General Data Protection Regulation (“GDPR”) currently
in force throughout Europe and available to all citizens of the European Union.
You can assert the following rights against us within the scope of the GDPR in relation to your personal data:

● Your right to erasure under Article 17 GDPR,

● You also have a right to lodge a complaint the competent data protection supervisory authority (Article 77
GDPR in conjunction with § 19 BDSG).
● You can also withdraw a given declaration of consent to the processing of your personal data at any time.
Please note that this declaration cannot work retrospectively.
17. CLAUSES SPECIFIC TO USERS WHO ARE DOMICILED IN CALIFORNIA
The laws in force in the state of California, United States of America, requires the Company to state the various
rights that the California Consumer Privacy Act (“CCPA”) provides to those people who are domiciled in
California. The CCPA grants state residents’ certain rights, including the rights to access specific types of
personal data, to learn how we process personal data, to request deletion of personal data, and not to be denied
goods or services for exercising these rights.
If you are an authorized agent wishing to exercise rights on behalf of a California resident, please contact us and
provide a copy of the consumer’s written authorization designating you as their agent. 
We may need to verify your identity and place of residence before completing your CCPA rights request.
